  1. Limits and Restrictions
    • Responsibility for the original image lies with the client. A copy of the original should be sent to NHANCE Retouching, safe in the knowledge there is a backup of the original with the client. NHANCE Retouching is not liable for any loss or damage to the original file.
    • Corrections on images that have not been signed off as complete are done free of charge until the job has been signed off as complete by both parties. If further work or a correction is required after an image has been signed off as complete by the client; then a further cost will be charged in order to complete such work.
  1. General
    • NHANCE Retouching inc. Mark Lintern reserves the right to amend, vary or cancel these terms and conditions at any time.
    • Clients images may be used by NHANCE Retouching, from time to time, for marketing purposes in print and online in all forms of communication in order to aid the promotion of NHANCE Retouching.
    • Complaints: Resolution of issues require that the client contacts Mark Lintern (NHANCE retouching) directly via email at mark@nhance-retouching.co.uk. All complaints and issues are to be handled in written format, to ensure a record is kept of all correspondence.
  1. Pricing
    • Quotes are available on request. Pricing is not ‘set in stone’ and will depend on the amount of and type of artwork required for each job.
    • Price includes relevant retouching to the required standard and level agreed upon. Additional non agreed retouching will be subject to a further charge.
    • Corrections that include elements of agreed retouching that have been missed or inadequately performed will be edited free of charge.
    • On going clients will be notified on price increases via email as and when this occurs.
    • All prices and quotes exclude VAT.
  1. Payment terms
    • Payment is due within 15 working days after the client has received an invoice for work performed. Invoices are generally sent via email so there is no dispute over dates of invoices sent and received. If you would like your invoices sent via post please advise our accounts department at least 14 days before the end of the month; a small postage fee will be applied to the invoice for signed delivery charges at the current rate.
    • Should payment for services rendered not be received within the 15 working day period, NHANCE Retouching reserves the right to charge interest on overdue payments in accordance with the ‘Late Payment of Commercial Debts Act 1998’ at 8% above the Bank of England base rate. Interest will be accrued until the debt is settled. Should there be a failure to pay beyond 30 days of the invoice deadline then NHANCE Retouching reserves the right to enforce debt collection which will incur a £42 compensation and handling fee on top of the interest owed as a result of instigating the debt collection process.
  1. Copyright
    • Copyright of the original image remains first and foremost that of the photographer. Any enhancement, retouching or artwork applied to an image remains copyright of Mark Lintern / NHANCE-Retouching. Should there be a dispute over the copyright of an image which has been artworked by NHANCE Retouching, whereby the client or photographer is claiming full copyright of the edited image; NHANCE Retouching reserves the right to legally demand the removal of artwork from said image – resulting in the original photograph/image being used in its place.
  1. Privacy
    • NHANCE Retouching will do its upmost to keep the clients details private, using industry standard virus, spyware, malware and firewall protection and will keep these up to date and is not liable for any breach of client confidentiality.
    • NHANCE Retouching will not send any sensitive information such as bank details or passwords via email which can be intercepted by a third party, and is not liable for the interception of client information where the computer security systems of NHANCE Retouching have been illegally breached or in a situation where the client demands to be sent sensitive information online – in this instance the client will be held responsible for the interception of any sensitive data.
